1. Services

Marfesto provides websites, lead follow-up and local growth systems for Dutch SME businesses. Depending on the selected package or written agreement, the service can include:

• Design and build of a professional business website
• Hosting, SSL certificate and custom domain connection
• Ongoing technical support
• Content changes via the customer portal
• CRM, lead confirmation, inbox, appointments and follow-up workflows
• Google Business Profile work, local monitoring, content growth and growth reporting where agreed

2. Subscription & Payment

• The subscription is billed monthly in advance.
• Payment is made by direct debit (SEPA).
• Marfesto Website is €89/mo excl. VAT.
• Marfesto Leads is €249/mo excl. VAT, with one-time setup from €399 excl. VAT.
• Marfesto Maps is €249/mo standalone or €199/mo as a Leads add-on, excl. VAT.
• Content Growth starts at €299/mo excl. VAT.
• Complete Growth is €699/mo excl. VAT.
• Growth Monitor is €149/mo excl. VAT and is included in Content Growth and Complete Growth.
• Monthly subscriptions have no minimum contract period unless agreed otherwise in writing.
• SMS, WhatsApp, phone, advertising and external channel costs are fair-use or agreed separately.
• Connections are configured during onboarding and can depend on channel or account approval.
• Prices are exclusive of VAT (21%).
• Price changes are announced at least 30 days in advance.

3. Cancellation

• Monthly subscriptions can be cancelled monthly unless otherwise agreed in writing.
• After cancellation, the website remains active until the end of the paid period unless otherwise agreed in writing.
• After the paid period, Marfesto may end hosting and management.
• Cancel via the customer portal or email opzegging@marfesto.com.

4. Liability

• Marfesto's liability is limited to the subscription fee for the relevant month.
• Marfesto is not liable for indirect damages, lost revenue, or consequential damages.
• Marfesto cannot guarantee uninterrupted availability, rankings, lead volumes, review outcomes or third-party channel approval.

5. Intellectual Property

• The customer retains ownership of all their own content (text, photos, logos).
• The website template and technical infrastructure remain Marfesto's property.
• On cancellation, the customer can download all their content via the portal.

6. Customer Obligations

• The customer provides accurate and up-to-date business information.
• The customer may not use the website for illegal activities.
• The customer is responsible for content added via the portal.

7. Governing Law

These terms are governed by Dutch law. Disputes are submitted to the competent court in The Hague, the Netherlands.
